Gary Scott, a 24-year-old high school teacher in Jacksboro, Tennessee, challenges the validity of the Butler Act, the Tennessee law originally challenged — unsuccessfully — by John T. Scopes. Gary Scott was fired for teaching his class about the theory of evolution.
Scott is being represented by William M. Kunstler, a noted attorney from New York, who says:
"We contend that this law violates the First Amendment, particularly as affecting academic freedom, freedom of thought and belief."
The legal challenge will be rendered moot because the next day the state senate repeals the law.
