Lawyers for Loren H. Wittner, an atheist employed by the Internal Revenue Bureau, withdraw his lawsuit over evolution in public schools in the District of Columbia.

Wittner originally filed suit to get the government to enforce a provision banning the teaching of "disrespect for the Holy Bible" in public schools. His goal was to have the provision struck down as unconstitutional.

He's forced to withdraw the lawsuit because he's suing as a taxpayer and there are serious questions about whether he has sufficient standing for his lawsuit.

Wittner's lawyers say they intend to re-file the lawsuit with someone else as plaintiff — someone with more standing and therefore a better chance of getting the lawsuit seen through rather than thrown out on a technicality.
