Lewis F. Powell Jr. is sworn in as an Associate Supreme Court Justice. Powell will become known as a moderate justice who seeks consensus rather than confrontation.

In a memorandum entitled "Attack on the American Free Enterprise System," but better known simply as the Powell Memorandum, he complains about increased regulation of private businesses and says:

"The most disquieting voices joining the chorus of criticism came from perfectly respectable elements of society: from the college campus, the pulpit, the media, the intellectual and literary journals, the arts and sciences, and from politicians."

Powell advocates for "constant surveillance" of textbooks and the media, for a purging of left-wing elements from public culture, and for an aggressive approach by the U.S. Chamber of Commerce to take control of law, public policy, and the government.
