In Alabama, the American Association for· the Advancement of Atheism challenges attorney J.N. Powell on his contention that the death-bed statements of atheists should be discounted.

Emma Marshall, convicted of murdering her husband, is appealing to have her sentence thrown out because his death-bed accusation should be not accepted due to his atheism.

J.N. Powell is the attorney for Emma Marshall and claims that

"An infidel's dying statement should not receive the same credence as that given to the word of a believer in God and the hereafter.

My contention is that if a man is an infidel he would as soon make a false statement on his deathbed as he would in the prime of life."
